LEGAL & ETHICS

HOTLINE Q&A

Republished from TN Realtors®

The Digest: 11/15/2021

Referral Fees And Bribery

Q: Why are we only able to give referral fees to licensed agent and not past clients. Isn’t this discrimination? Couldn’t it be considered bribery?

A: "A real estate licensee shall not give or pay cash rebates, cash gifts or cash prizes in conjunction with any real estate transaction.  As part of the Tennessee Real Estate Commission's general rule making authority the commission may regulate the practices of real estate licensees in regard to gifts, prizes or rebates that are not otherwise prohibited by law."  Tenn. Code Ann. § 62-13-302(b).

It is not discrimination because a referral of a customer for the sale of real estate is an activity which requires a real estate license, so therefore only licensees can be compensated. We think the statute was put in place prohibiting payments to consumers to prevent any bribery.
